BackWeb Announces Settlement Agreement with Sybase and Trial Date for Patent Infringement Lawsuit
SAN JOSE, Calif., September 30, 2009 - BackWeb Technologies Ltd. (Pink Sheets: BWEBF or BWEBF.PK) announced today that it has reached a settlement in its previously announced patent infringement litigation with Sybase, Inc. and its subsidiary iAnywhere Solutions, Inc. It also announced that a trial date of April 4, 2011 has been set by the court for the trial concerning BackWeb's lawsuit against the remaining defendants, Microsoft Corporation and Symantec Corporation.
On March 20, 2009, BackWeb filed a patent infringement lawsuit against Microsoft Corporation, alleging patent infringement and seeking damages, an injunction and a declaration by the Court that Microsoft's software update technologies infringe BackWeb's patents. On April 15, 2009 the lawsuit was amended to include Sybase and iAnywhere. On July 22, 2009 the lawsuit was amended to include Symantec Corporation.
BackWeb and Sybase have negotiated a settlement agreement under which Sybase and iAnywhere acquired a license to the BackWeb patents in question and the companies' claims have been resolved. Terms of the agreement remain confidential.
In a case management conference on September 15th, United States District Judge Claudia Wilken of the Northern District Court of California issued orders concerning case scheduling.
